Benjamin Halliwell

Ben's experience and expertise in the emerging carbon capture market, organisatonal change, transactional compliance and governance architecture is valued by his commercial clients in corporate finance and public institutions.

Ben Halliwell is the founding principal of Halliwell Morgan Commercial Lawyers. He is an experienced corporate adviser, and more recently commercial lawyer with over 20 years consulting experience to  Australian and international financial markets.

His approach is grounded in deep financial literacy and commercial realism, shaped by senior roles in funds management and stockbroking, together with experience as a Commercial Trustee in the structured finance sector.

 

A significant and defining aspect of Ben’s practice is his work with Indigenous engagement, where he is trusted implicitly by both commercial partners and community. Ben brings a nuanced understanding of regulatory frameworks, public policy, and cultural considerations to ensure outcomes are commercially robust, legally sound, and aligned with all parties.

Ben also advises on complex corporate and infrastructure projects across construction, agriculture, ports, oil and gas, and emerging climate-related sectors for both large private and listed entities. His work commonly includes due diligence, strategic and commercial planning, capital structuring and sourcing, price discovery, and business development, often in high-stakes or highly regulated environments.

He is known for his pragmatic, tenacious, and solutions-focused approach, guiding clients through regulatory uncertainty, governance challenges, and long-term business planning with clarity and confidence.

In addition to his advisory practice, Ben has extensive governance experience, having held senior board and committee roles including;

  • Premium Funds Investment Committee (STLFS, Melbourne, including AAA-rated funds).

  • Paragon Treasury (STL, Victoria).

  • Australian Football League (Northern Territory).

  • Red Cross Investment Committee (Northern Territory).

  • St Mary’s Football Club (AFLNT).

  • Regional council for FINSIA (SA/NT).

Ben also holds an academic appointment as Assistant Editor of the Udayana Journal of Law and Culture at the University of Udayana, in Indonesia.

In his spare time Ben writes poetry. In 2022, he was long-listed in the Peter Porter Poetry Prize for his poem, ‘Thinking of Bullocky’.

Amy aspires to making her mark in the law by applying her curiosity, her industry and her scholarship in the pursuit of valuable, practical solutions for the firms commercial clients.


Amy is an admitted lawyer of the Supreme Court of Victoria (June 2025), with strong focus in commercial, planning, and regulatory law. She holds a Bachelor of Laws from RMIT University, where she was awarded the Dean’s Merit Award for Academic Excellence in the Law of Climate Change, reflecting her dedication to understanding complex regulatory and environmental issues.


Amy deliberately skewed her course towards commerce and industry by studying emerging legal principles relating to artificial intelligence, big data, blockchain, intellectual property, successful enterprise and the regulatory framework for climate controls.

She has gained practical experience across both commercial and community legal contexts through internships at specialist law firms and volunteering with community legal services. These roles have provided her with a solid foundation in legal drafting, statutory compliance, and client engagement.


Amy is passionate about applying her knowledge and skills to support clients with practical, thoughtful legal solutions. She combines a strong work ethic with a passion for the law to deliver considered and practical legal support.

Amy’s grounded and considered approach to life is shaped by her upbringing and education in country Victoria, within a close and supportive family environment. Working in Melbourne affords Amy the opportunity to indulge her passion for fashion and creativity, alongside the law.
